TERMS OF USE

1. INTRODUCTION

These Terms of Use (hereinafter referred to as the “Terms”) govern your access to and use of the website https://www.greenockcruiseport.com/ (the “Website”) and the services provided by Global Ports Holding Limited and its subsidiaries operating in Greenock (collectively referred to as the “PROVIDER,” “we,” “us,” or “our”).

By accessing the Website or using our services, you (the “USER”) agree to be bound by these Terms.

By accepting these Terms, the USER:

  • Confirms that they have read, understood, and accepted these Terms;
  • Declares that they possess the legal capacity to enter into contracts under the Consumer Rights Act 2015 and the Contracts (Rights of Third Parties) Act 1999, as applicable in Scotland;
  • Assumes all obligations and responsibilities set forth herein.

These Terms remain valid indefinitely and apply to all interactions with the Website unless otherwise stated by the PROVIDER.

The PROVIDER reserves the right to modify these Terms unilaterally at any time, provided that such changes do not retroactively affect services or agreements already executed. Any updates will be communicated through the Website or other suitable channels, in compliance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and The Electronic Commerce (EC Directive) Regulations 2002.

 

2. PARTIES TO THE AGREEMENT

The contracting parties to these Terms are:

  • The PROVIDER: Global Ports Holding Limited, a company registered in the United Kingdom, with its principal address at 35 Albemarle Street, 3rd Floor, W1S 4JD, London – UK, and its operational offices at 8 Custom House Way, Greenock PA15 1EW, Greenock Cruise Port, United Kingdom.
  • The USER: Any individual accessing the Website or utilizing the services, who is responsible for ensuring the accuracy and completeness of all information submitted during interactions with the PROVIDER.

 

3. PURPOSE OF THE TERMS

These Terms define the contractual relationship between the PROVIDER and the USER, which arises when the USER interacts with the PROVIDER through the Website or in person at Greenock Cruise Port. This relationship primarily concerns the provision of services as described on the Website, subject to the fees and conditions displayed or otherwise agreed upon.

Compliance under United Kingdom and Scottish Law

  • Consumer Rights & Cancellation Policies: The rights of consumers, as established under the Consumer Rights Act 2015 and The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, will be fully observed and clearly communicated in sections regarding withdrawal or cancellation rights.
  • Electronic Commerce Transactions: In accordance with The Electronic Commerce (EC Directive) Regulations 2002, all electronic contracts will provide clear confirmation of applicable terms before execution, ensuring that the USER has an opportunity to review and accept them prior to completion.
  • Pricing Transparency: Any services involving fees will be presented clearly and accessibly, and the USER will be required to give explicit consent before any payment is made, in compliance with The Consumer Protection from Unfair Trading Regulations 2008.

 

4. CONTRACTING PROCEDURE

To access or use certain services provided by the PROVIDER, the USER must complete a registration process through the Website. During registration, the USER is required to provide accurate and up-to-date personal information in accordance with the Consumer Rights Act 2015 and The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The USER must create a secure user account protected by a username and password, which must be kept confidential. Any unauthorized use or security breach must be reported to the PROVIDER immediately.

By completing the registration process, the USER acknowledges and agrees that their personal data will be processed in accordance with the PROVIDER’s Privacy Notice, prepared in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Access to services remains subject to availability and, where applicable, to the successful completion of any required payment, as detailed in Section 9 of these Terms.

 

5. GENERAL TERMS OF SERVICE

The following general conditions apply to all services made available through the Website. All services are governed exclusively by these Terms, and no other stipulations, whether verbal or written, shall be binding unless expressly accepted in writing by the PROVIDER.

Services are provided on an “as-is” basis, without any warranties or guarantees beyond those expressly stated in these Terms or required under the applicable laws of the United Kingdom, including Scotland.

For any service subject to payment, the total price—together with all applicable taxes, fees, or additional charges—will be clearly communicated to the USER before confirming the purchase, in compliance with The Consumer Protection from Unfair Trading Regulations 2008 and The Price Marking Order 2004.

 

6. RIGHT OF WITHDRAWAL

The USER may exercise their right to withdraw from a service agreement under the conditions established by The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The USER has 14 calendar days from the conclusion of the service agreement to withdraw, unless the service has already been fully performed with the USER’s explicit consent and acknowledgment that the right of withdrawal will be lost upon full execution.

The right of withdrawal does not apply to services that are personalised, involve legally binding documentation, or concern the supply of digital content not provided on a tangible medium, where performance has begun with the USER’s prior express consent and acknowledgment of the loss of the right to withdraw, in accordance with Regulation 28 of The Consumer Contracts Regulations 2013.

How to Withdraw

Withdrawal requests must be submitted via email to dpo@globalportsholding.com or in writing to the PROVIDER’s local office at Greenock Cruise Port.
For contracts concluded electronically, the right of withdrawal and its conditions will be presented to the USER before confirming the transaction, in compliance with Regulation 14 of The Consumer Contracts Regulations 2013.

 

7. DISPUTES AND LIABILITY

The PROVIDER is committed to ensuring a smooth and satisfactory experience for all USERS. Should any dispute or issue arise, the USER may submit a written complaint via email to info@greenockcruiseport.com, including a detailed description of the matter. The PROVIDER will respond to all complaints within 30 days, either resolving the issue or providing a reasoned explanation if resolution is not possible within that period.

In accordance with The Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, USERS may also access alternative dispute resolution (ADR) mechanisms within the United Kingdom. Consumers may additionally use the Online Dispute Resolution (ODR) platform provided by the European Commission, available at https://ec.europa.eu/consumers/odr.

Nothing in these Terms shall exclude or limit the PROVIDER’s liability where such exclusion or limitation is prohibited under applicable law in Scotland.

 

8. FORCE MAJEURE

Neither party shall be held liable for delays or failures to fulfill obligations due to circumstances beyond reasonable control, including but not limited to: (i) Natural disasters (e.g., earthquakes, floods, storms), (ii)governmental actions or regulatory changes, (iii) acts of war, terrorism, or civil disturbances, (iv) industrial disputes or labor strikes not caused by the affected party

Obligations under this agreement shall resume promptly after the force majeure event has concluded. This provision is governed by UK contract law and, in the context of Scotland, by the doctrine of frustration as recognised under Scots law and the Law Reform (Frustrated Contracts) Act 1943.

 

9. PRICING AND PAYMENT TERMS

All service prices are displayed in British Pounds (GBP) and include applicable Value Added Tax (VAT), unless otherwise stated. Payments may be made by credit card, electronic bank transfer, or any other approved method indicated on the Website. Any queries or issues related to payments should be directed to info@greenockcruiseport.com.

In compliance with The Price Marking Order 2004 and the Consumer Rights Act 2015, all pricing information, including applicable taxes, fees, and total amounts payable, will be clearly communicated to the USER before confirming any transaction.

Invoices will be issued in accordance with applicable UK and Scottish tax regulations.

 

10. APPLICABLE LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Scotland, without prejudice to the protection afforded to consumers by any mandatory provisions of the law of their country of residence, in line with the principles set forth under Regulation (EC) No. 593/2008 (Rome I).

Any disputes arising from or in connection with these Terms shall fall under the exclusive jurisdiction of the competent Scottish courts, in accordance with the Civil Jurisdiction and Judgments Act 1982 and applicable UK consumer protection laws.
